Acceptable Use Policy

Overview

This Acceptable Use Policy ("AUP") governs the use of Day AI’s services and is incorporated by reference into the Day AI Terms of Service. Capitalized terms not defined herein have the meanings set forth in the Terms of Service. Enforcement under this AUP is in addition to, and does not limit, Day AI’s rights under the Terms of Service, including the suspension and termination provisions therein.

Prohibited Conduct

You may not use the Services to:

(a) Violate any applicable law, regulation, or third-party rights;

(b) Publish, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;

(c) Impersonate any person or entity, or falsely claim an affiliation;

(d) Submit or transmit any malware, viruses, worms, Trojan horses, or other harmful code;

(e) Interfere with or disrupt the Services, servers, or networks connected to the Services;

(f) Attempt to gain unauthorized access to the Services, other accounts, or computer systems;

(g) Use the Services to send unsolicited communications (spam);

(h) Harvest or collect personal information about other users without their consent;

(i) Use the Services for benchmarking or competitive analysis without Day AI’s prior written consent;

(j) Access or use the Services if you are a direct competitor of Day AI, except with Day AI’s prior written consent;

(k) Circumvent any usage limits, rate limits, or technical restrictions of the Services;

(l) Use automated means (including bots, scrapers, or similar technology) to access the Services without Day AI’s prior written consent.

AI-Specific Restrictions

You may not:

(a) Use AI-generated outputs from the Services to discriminate against any individual or group;

(b) Use the Services or any output thereof to train, develop, or improve any artificial intelligence or machine learning model that competes with the Services;

(c) Input content into the Services that is illegal, harmful, or that you do not have the right to process;

(d) Use AI features to make fully automated decisions that produce legal or similarly significant effects on individuals without appropriate human oversight;

(e) Misrepresent AI-generated content as human-generated content in contexts where such distinction is material.

API Usage

If you access the Services via API:

(a) You must comply with all published API documentation and rate limits;

(b) You may not exceed the usage limits associated with your subscription plan;

(c) You must implement reasonable security measures to protect your API credentials;

(d) You may not share API credentials with unauthorized parties.

Enforcement

(a) Day AI will provide written notice and a minimum of five (5) business days to cure prior to any enforcement action, except for violations involving: (a) transmission of malware or harmful code; (b) unauthorized access to other customers’ data; (c) denial-of-service attacks; (d) data exfiltration; or (e) any activity that poses an imminent threat to the security, integrity, or availability of the Services, in which cases immediate suspension is authorized.

(b) Enforcement actions may include: written warning, temporary suspension of access, permanent termination of access, and removal of offending content.

(c) Day AI reserves the right to report any activity that it suspects violates any law to appropriate law enforcement authorities.

(d) Appeal Process. Customer may appeal any enforcement action by contacting legal@day.ai within ten (10) business days of receiving notice. Day AI will review the appeal and respond within five (5) business days. During the appeal of a suspension (other than for imminent security threats), Day AI will use commercially reasonable efforts to provide Customer with read-only access to Customer Content for export purposes.

Reporting Violations

If you become aware of any violation of this AUP, please report it to legal@day.ai.

Changes to This Policy

Day AI may update this AUP from time to time. Material changes will be communicated with at least 30 days’ advance notice.
